Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Tethr, based in Pasadena, California ("Tethr," "we," "us," or "our"), governing your use of the Tethr website and mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

3. What Tethr is, and what it is not

Tethr is a non-clinical recovery support and reflective companion product. It offers tools such as daily check-ins, journaling, progress tracking, and Haven, an AI companion designed to be a warm, private, always-available source of support for the moments between meetings, appointments, and everyday life.

Tethr is not, and does not provide:

  • Therapy, counseling, or psychotherapy;
  • Medical, psychiatric, or clinical care, diagnosis, or treatment;
  • Crisis intervention or emergency services;
  • A substitute for professional advice from a licensed therapist, counselor, physician, or other qualified provider; or
  • A doctor-patient, therapist-client, or other professional or fiduciary relationship.

Haven and Tethr are recovery support and reflective companionship only. Nothing in the Service should be interpreted as professional advice. Always seek the advice of a qualified professional with any questions about your health, mental health, or recovery, and never disregard or delay seeking professional advice because of something you read or were told through the Service.

4. Medical disclaimer and emergencies

The Service is not for emergencies. Tethr and Haven cannot help in a crisis and are not monitored by humans in real time.

If you are experiencing a medical or mental health emergency, are thinking about harming yourself or others, or are in danger, call or text 988 (the Suicide and Crisis Lifeline in the U.S.) or call 911 immediately, or go to your nearest emergency room. Do not rely on Tethr or Haven for help in an emergency.

5. Haven and artificial intelligence

Haven's responses are generated by artificial intelligence using third-party AI models. You understand and agree that:

  • Haven is software, not a person, and is not a licensed therapist, counselor, or medical professional;
  • Haven's responses may be inaccurate, incomplete, or not appropriate for your situation, and you use them at your own discretion and risk;
  • Haven does not diagnose, treat, or provide professional advice, and is not a substitute for professional care;
  • You should not rely on Haven for decisions about your health, safety, medication, treatment, or finances; and
  • We are continually developing Haven and may change, limit, or discontinue its features at any time.

6. Subscriptions, free trial, billing, and cancellation

Free trial. Tethr offers a 7-day free trial.

Subscription. After any free trial, access to the Service requires a paid subscription of $49 per month (or the then-current price), billed in advance on a recurring basis until cancelled. Prices are in U.S. dollars and may exclude applicable taxes.

Auto-renewal. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us and our payment processors to charge your payment method on a recurring basis.

How to cancel.

  • If you subscribed directly through Stripe on the web, you may cancel at any time through your account settings or by contacting support@tethred.com. Cancellation takes effect at the end of the current billing period.
  • If you subscribed through the Apple App Store or Google Play, you must manage and cancel your subscription through your Apple or Google account settings, and the app store's billing terms and refund policies apply to that purchase.

Refunds. Except where required by law or by the applicable app store's policies, payments are non-refundable, and we do not provide refunds or credits for partial billing periods.

Price changes. We may change subscription prices. We will give you advance notice, and any change applies to billing periods after the notice. If you do not agree, you may cancel.

7. Your content

"Your Content" means the information you submit to the Service, including your check-ins, journal entries, and messages to Haven.

  • You own Your Content. We do not claim ownership of it.
  • License to operate the Service. You grant us a limited, non-exclusive license to store, process, transmit, and display Your Content solely to provide and maintain the Service for you, including sending your messages to our AI provider to generate Haven's replies, as described in the Privacy Policy.
  • Your responsibility. You are responsible for Your Content and confirm you have the right to submit it.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Use the Service to provide professional, medical, or therapeutic services to others;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Interfere with or disrupt the Service, or attempt to reverse engineer, scrape, or misuse it;
  • Upload malicious code or content that is unlawful, infringing, or harmful; or
  • Misrepresent your identity or your age.

We may suspend or terminate accounts that violate these Terms.

9. Intellectual property

The Service, including its software, design, text, and the Tethr and Haven names and logos, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

10. Third-party services

The Service relies on third-party providers, including Supabase, Anthropic, Stripe, Vercel, and the Apple and Google app stores. Your use of the Service may also be subject to those providers' terms. We are not responsible for third-party services.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT HAVEN'S RESPONSES WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR SITUATION. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TETHR OR ITS OWNERS, OFFICERS, EMPLOYEES, OR PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

13. Indemnification

You agree to indemnify and hold harmless Tethr and its owners, officers, employees, and providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination, including Sections 7, 9, 11, 12, and 13, will survive.

15. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify you through the Service or by email and update the "Last updated" date. Your continued use after the changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

17. Apple App Store additional terms

If you download Tethr from the Apple App Store, the following also applies. These Terms are between you and Tethr only, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. Apple is not responsible for any product warranties or for addressing any claims relating to the Service, including product-liability, legal or regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list, and you agree to comply with applicable third-party terms when using the Service.
